Houston police officers Teen Chad Holley - Civil violation? Or criminal assault?

On 23 March 2010, a 15-year-old child was arrested for robbery in Houston, Texas. A surveillance camera captured the arrest on tape and showed police officers beat and kicked the now 16-year-old Chad Holley. Officers and the district attorney tried to dismiss the band of evidence, they did not get a fair trial. Should the tape be approved?
